Terms & Conditions

This website is owned by The Brompton Wine Company Ltd (hereafter the “Merchant” or “We”, “Our” or “Us”) registered in England, Registration No. 06139243, with registered address at 42-46 Station Road, Edgware, England, HA8 7AB and with email address at sales@bromptonwine.co.uk.

Any use of this site or purchase of goods from the site www.bromptonwine.co.uk (hereafter the “Merchant Site”) is subject to these terms and conditions which the customer (hereafter “You”, “Your”) are deemed to have consulted and accepted by continuing to use the Merchant Site. By clicking to submit an order, You are proposing to purchase the goods comprised in that order from the Merchant on these terms and conditions and Your click represents Your "digital signature" on such contract should Your proposal be accepted by the Merchant.

1. Purpose

These terms and conditions define the rights and obligations of the Merchant and You.

2. Product Information

2.1 Every effort is made to ensure the accuracy of the products offered by Us on the Merchant Site but product descriptions, availability and prices are non-contractual until an order has been accepted by Us as set out in paragraph 4.3 below.

2.2 We reserve the right to withdraw any product from sale at any time.

3. Minors

3.1 You must be over the age of eighteen years in order to purchase products from the Merchant Site.

3.2 When You give Us Your credit or debit card details, You are confirming that:

A) You are the cardholder or that You have permission from the cardholder to use the card for the purpose of ordering wine; and

B) You are over 18 years of age.

4. Order Confirmation

4.1 Submitting an order on the Merchant Site does not oblige the Us to supply the goods. The Merchant’s acceptance of an order takes place only when We dispatch the order to You. If We cannot accept Your order for any reason, Your payment will be refunded in full and We will contact You by e-mail to inform You that We are unable to fulfil Your order.

4.3 We cannot guarantee that wines will be any specific vintage, unless expressly indicated to be a particular vintage on the order form and confirmed by Us in accepting Your order under paragraph 4.1 above.

5. Delivery Terms

5.1 We will deliver the goods to the address which You specified on the order provided that this is within the mainland UK. We do not deliver to JE or GY postcodes.

5.2 The cost of delivery will be £15 on orders less than £200 in value. Orders over £200 in value are delivered free of charge within approved delivery zone.

5.3 We will provide You with an anticipated delivery date when We accept Your order. Please note that the delivery time depends on the postcode of the delivery address and the size of the order. We do not guarantee delivery within any timeframe and any delivery dates notified to You are only estimates.

5.4 Delivery takes place when the products are left at your delivery address or with someone else in accordance with Your instructions. We do not accept any responsibility for the goods if You have asked us to leave them in a designated place or address.

5.5 Please let us know as soon as possible if there is a problem with Your delivery and We will try to rectify it. If Your order is damaged on arrival, You must notify us within 3 days and provide photos of the damaged items and packaging.

6. Warranty

6.1 We will provide a full refund or replacement for any wines that are faulty. This does not affect Your statutory rights.

6.2 We may require faulty bottles to be returned to us. We will arrange this as necessary at Your convenience.

6.3 As a consumer, You have certain legal rights regarding the return of faulty or misdescribed goods. Our refund procedure described above does not affect Your legal rights in relation to such goods. Our returns policy is in accordance with statutory rights under the Consumer Contracts Regulations. For further information about Your legal rights contact Your local authority Trading Standards Department, or Citizens Advice.

7. Liability

7.1 Nothing in these Terms & Conditions will restrict Our liability for death or personal injury resulting from Our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of Your statutory rights. For further information about Your statutory rights, contact Your local authority Trading Standards Department or Citizen's Advice Bureau.

7.2 In addition to paragraph 5.4, We will not be deemed to be in breach of contract or of these Terms & Conditions as a result of any delay in Our performance or failure to perform Our obligations if that delay or failure to perform is due to any cause or circumstance beyond Our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

7.3 Other than as set out in clause 7.1, Our maximum liability arising out of any order for the supply of goods to You under this contract will be limited to the retail price of the goods contained in that order.

8. Right to Withdrawal

You have the right to cancel Your order at any time until fourteen (14) working days after delivery of Your order. Should You decide to cancel, You must notify Us by email at sales@bromptonwine.co.uk. All payments made by You for the goods (including standard delivery charges) will be refunded within 14 days of the goods being received by us in merchantable condition. You are responsible for the cost of returning the goods and for any damage to or loss of the goods in transit.

9. Privacy

9.1 We respect Your privacy. The personal information that You give us is held with care and security. We will not share this information with any third parties except if required to by law. We may however, use it, occasionally, to contact you to provide you with information regarding Our products, or to advise You of any offers or promotions. If You wish to have Your details removed from our database, please do not hesitate to contact Us and We will do so, immediately.

9.2 At the time of Your registration You will receive a password. Please keep this secret, as You are entirely responsible if You do not maintain the confidentiality of Your password. You are entirely responsible for all orders placed with us or information given to us under Your e-mail address in combination with Your password. You must immediately notify us of any unauthorised use of Your e-mail address and/or password or any breach of security known to You.

10. General

10.1 If any of these Terms & Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms & Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

10.2 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Merchant Site shall remain at all times vested in us or Our licensors. You are permitted to use the material data and content only for Your personal use in placing orders through the Merchant Site, and You may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the Merchant Site without Our prior written permission.

10.3 These Terms & Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
